Terms & Conditions

Last updated: 11 August 2026 · These Terms are governed by the laws of the Republic of South Africa.

1. Who we are (section 43, ECT Act)

In compliance with section 43 of the Electronic Communications and Transactions Act 25 of 2002 (“ECT Act”), the following information is provided:

• Service name: PageStack — an AI-assisted website builder (“the Service”).
• Operated by: PageStack (“we”, “us”, “PageStack”).
• Email: support@pagestack.co.za
• Website: the domain on which this page is hosted.
• Physical address: available on written request to the email address above.

2. Definitions

• “CPA” means the Consumer Protection Act 68 of 2008.
• “POPIA” means the Protection of Personal Information Act 4 of 2013.
• “User Content” means any prompts, text, images, files, imported sites, or other material you submit to the Service.
• “Generated Content” means websites, code, and other output produced by the Service in response to your prompts.
• “you” / “your” means the person or entity using the Service.

3. The Service

PageStack lets you generate websites from plain-English descriptions, import existing sites, edit and version them, publish them, and connect custom domains. The Service uses artificial-intelligence models to produce Generated Content. AI output can contain errors or inaccuracies — you are responsible for reviewing Generated Content before publishing or relying on it.

4. Accounts and registration

• You must provide accurate registration information and keep your sign-in credentials confidential.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old, or use the Service under the supervision of a parent or guardian who agrees to these Terms.
• Notify us immediately at support@pagestack.co.za if you suspect unauthorised use of your account.

5. Acceptable use

You may not use the Service to create, host, publish, or distribute content that:

• is unlawful under South African law, or infringes any person's rights (including intellectual-property and privacy rights);
• is defamatory, hateful, harassing, or incites violence or discrimination;
• constitutes spam, phishing, malware, or any deceptive or fraudulent scheme;
• is sexually explicit involving minors, or otherwise exploits or harms children;
• attempts to probe, disrupt, overload, or gain unauthorised access to the Service or any other system.

We may remove content, unpublish sites, or suspend or terminate accounts that breach this clause.

6. Your content and intellectual property

• You retain ownership of your User Content. You grant us a non-exclusive licence to host, process, display, and back up your User Content solely to operate and improve the Service.
• Subject to these Terms and any third-party rights, the Generated Content produced for you may be used by you for any lawful purpose, including commercially.
• The PageStack platform itself — including its software, design, and branding — remains our property and may not be copied or reverse-engineered except as permitted by law.
• You warrant that your User Content does not infringe the rights of any third party and indemnify us against claims arising from it.

7. Fees, billing, and cooling-off

• Where paid plans are offered, prices are displayed in South African Rand (ZAR) inclusive of VAT unless stated otherwise, and are processed by a third-party payment provider.
• Subscriptions renew automatically until cancelled. You may cancel at any time, effective at the end of the current billing period.
• 7-day money-back guarantee: if you cancel a paid subscription within 7 days of first signing up for it, we will refund the subscription fees you paid for that plan in full, less the registration cost of any domain already registered at your request (domain registrations cannot be reversed once made). Refunds are processed to your original payment method within 14 days of cancellation. This guarantee is in addition to, and does not limit, your cooling-off rights under section 44 of the ECT Act or your rights under the CPA.
• In terms of section 44 of the ECT Act, you may cancel certain electronic transactions within 7 days without reason or penalty. This cooling-off right does not apply where an exclusion in the ECT Act applies (for example, services whose performance has begun with your consent).
• Nothing in these Terms limits your rights under the CPA, where the CPA applies to you.

8. Availability and support

We aim to keep the Service available at all times but do not guarantee uninterrupted or error-free operation. We may perform maintenance, and we may modify or discontinue features with reasonable notice where practical. 9. Disclaimers and limitation of liability

• Except as expressly provided in these Terms or required by the CPA, the Service is provided “as is” and “as available”.
• We do not warrant that Generated Content will be accurate, complete, fit for a particular purpose, or free of third-party rights — you must review it before use.
• To the maximum extent permitted by law, we are not liable for indirect, special, or consequential damages, or loss of profits, data, or goodwill.
• To the extent liability cannot be excluded, our total liability for any claim is limited to the fees you paid to us in the 6 months preceding the claim (or R1,000 if you paid no fees).
• Nothing in these Terms excludes liability for gross negligence or wilful misconduct, or limits any right you have under the CPA that cannot lawfully be limited.

10. Privacy and data protection

We process personal information in accordance with POPIA and our Privacy Policy, which forms part of these Terms.

11. Suspension and termination

• You may close your account at any time.
• We may suspend or terminate your access if you materially breach these Terms, if required by law, or if the Service is discontinued (with reasonable notice where practical).
• On termination you should export your sites and data; we may delete account data after a reasonable period, as described in the Privacy Policy.

12. Disputes, governing law, and jurisdiction

• These Terms are governed by the laws of the Republic of South Africa.
• You consent to the jurisdiction of the South African courts, including the Magistrates' Courts where applicable, without limiting your right to approach any forum available under the CPA (including the National Consumer Commission or a consumer court).
• Before litigating, the parties will first attempt in good faith to resolve any dispute by direct negotiation via support@pagestack.co.za.

13. General

• We may update these Terms from time to time. Material changes will be notified on the website or by email, and the “last updated” date above will change. Continued use after changes means you accept them.
• If any clause is unenforceable, the remainder of the Terms stays in force.
• No failure to enforce a right is a waiver of that right.
• These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
